In this video Trent Chapman of Short Sale Genius talks about SB 931, the new California Short Sale Law that goes into effect January 1st 2011.
The sad fact is this law doesn’t break any new and important ground for real estate agents or homeowners who are trying to close a short sale without future liability. As it is currently, any agent who knows how to negotiate short sales can get the release of liability on a first lien in California without SB 931. So what SB 931 does is make it so any agent can get the release of liability on any first position loan in California.
If the state senators wanted to really help out the homeowners of California, they would have included second liens in this law, but true to form the government has passed another law that fails to truly help homeowner avoid foreclosure in any meaningful way.
It appears that if any agent wants to truly protect their homeowner, then have to learn to negotiate for themselves.
