You can fight the eviction until you are blue in the face, but you have NO rights beyond the standard eviction procedure. You have no lease to protect you and there are no new laws to pull out. With a short sale, your landlord still owns the house, it is not a foreclosure or bank owned, so those statutes do not apply to your situation.

Really, it is a little dumb to kick out a good tenant because he/they are trying to sell. Unless you are uncooperative with showings, you will probably be able to stay, but you need to talk to your landlord about his plans.
References :
Oregon Realtor

As long as you are paying rent in full all you are entitled to is a 60 day notice to vacate. There is nothing to "fight", you would be evicted for failure to vacate, in which the only argument is to prove you moved out.

And yes, if you are a jerk about leaving it will be on your credit report. You have absolutely nothing to gain by giving the owner a hard time.
References :
If you are not on a lease he will give you the customary notice to vacate. In Calif. it is 60 days if you have lived at a location more than a year. This is true even if he were not selling his house, for any reason, a landlord and a tenant can give notice and leave.

The Tenant in Foreclosure Act of 2009 does not apply to short sales or any sale of a house. But if the house is sold and you had a lease, your lease would survive a sale until it expires. With no lease, it is as I said.

You said you are paid up. If you stop paying rent you will be evicted. The house may not sell for months so what are you worried about? You get 60 days notice. You can move to a cheaper location to an apartment instead of a house.
References :
The landlord is selling the house. In this case, the short sale part means nothing. A short sale is between the owner and the bank. The owner is asking the bank to take less repayment then is owed to them. It is NOT a foreclosure. You have NO NO NO protection under the foreclosure protection.

You are on a month to month lease, with 30 days notice (or what was in the original lease or by state law), he can ask you to move. Period. You have no additional rights.

This is the major problem with renting vs owning your own home.

And your friends are wrong.
References :
You are protected for the term of the lease. No one can force you out while you are paying the rent on time.
References :
You mention nothing about a lease. If you are on a lease you can't legally be removed because of a sale until the lease expires. If you are on a month-to-month tenancy the only legal requirement for the landlord is to give you a 60 Day Notice To Terminate Tenancy.

Your friend's recommendation to fight the eviction is groundless. In California, unless you live in a rent controlled area, the landlord is not required to state any reason for the termination.

You are correct, with a short sale a tenant does not get any kind of special consideration as with a foreclosure.

The good thing that you might having going for you is that lenders seldom allow landlord's to short-sell their income producing property. Short sales are generally for "owner occupied" properties.

Black-listing tenants is against the law.....The only list that exists are tenants who are evicted, and that is a public record and would eventually appear on your credit history.
-----------------------------
Since you are not on a lease the only requirement would be the landlord to give you a 60 Day Notice. What city do you live in? Is it a rent control city?
---------------------------
Obviously Real Estate Guy doesn't know California law.....After a tenant has resided in a property over 12 months it takes a 60 Day Notice to Terminate Tenancy. Not 30 days
References :
I will be very honest. Many school districts right now are not looking to hire teachers period, because they are laying hundreds if not thousands off. Social studies teachers are a dime a dozen, and most of them usually are over qualified. You have a wonderful plan, however to be blunt, you need to know someone with power were you want to get a job, or you'll be looking for a long time. Now with your work experience what about going a math or science route? That would almost guarantee you a job where ever you want.
Also I don't know how long ago you graduated, but you what ever path you choose you want to make sure you are properly certified to teach. A master's degree doesn't mean anything if you aren't certified to teach.
References :
I'm a teacher with a history degree that couldn't get a job teaching social studies and had to be certified to teach elementary to get a job.
